What obligations are there on the cemetery when it actions the removal of a headstone or monument from a burial site?

The cemetery  needs to move a headstone for a period of time and does not have next of kin information. What is the cemetery obligated to do before moving the monument?




There are no specific obligations outlined in the Act, however we recommend that the operator makes all possible efforts to communicate with the owners of the grave, including placing notices for at least 30 days:

  • at the cemetery
  • on the noticeboard
  • on the grave
  • at the Council office
  • on the operator/Council website

It is recommended to record the notifications and period they were published, as well as carefully photographing and documenting the grave condition and any existing damage before commencing any works.
